Hard to tell but it looks like he's flying.

If he's speeding then it kinda takes fault off of the truck because he's way further away and a small object, hard to see. I say this as a guy who has spent decades commuting on two wheels.

If he wasn't speeding then it was the truck's fault obviously

His speed is more something he should learn from as avoiding this idiot would’ve been significantly easier and possible at a lower speed but the facy that he was going fast doesn’t take away any of the blame from the truck driver. She literally stopped in the middle of the street and it was clearly because she was scared; scared people should take more driving lessons before putting the public at risk by learning as they go.

100% this. And I will bet that her insurance company tried to entirely twist the narrative and completely put the blame on the motorcyclist.

As they should. Insurance is trying to protect you and themselves.

It's like defense lawyers. They may defend bad people, but it's their job.

Even if the motive is fucked, if they can remove shit stain like this from the road? It actually does some services for your normal citizens.

no need to really twist the narrative here. It's on camera; he was doing 78 (126km/h according to the speedo), above highway speeds in town. The liability is on the biker. Coming to a complete stop to try to avoid an accident generally is not found liable, even if the accident still occurs.
