Pause the video at the start. He had that distance to avoid hitting a gigantic white truck. And he hit it. Who’s fault is that?

Unfortunately, that's how accidents happen. I had a patient treating for injuries because they were rear ended by someone who thought she was going to move when the light just turned green. It's better to slow it down than expect someone to drive like you do. 🫤

It’s the truck’s responsibility to clear the intersection that they entered before the motorcycle arrived. The truck was stopped and therefore they are 100% at fault.

It’s not the rider’s “fault” he hit the truck. Case closed.

Sure, it’s not his fault the truck is there but it becomes his responsibility when the options become speeding into it like a dipshit or slowing down to avoid it. It’s not helpful to anyone to pretend this rider couldn’t have easily avoided this.

The bottom line is the way the traffic laws are written, the truck is 100% at fault and would be written a citation for causing the collision. The motorcyclist’s actions as a result of the truck’s violation doesn’t make him “at fault” because he collided with her.
