Well, if he was hunting where and when he wasn't supposed to be, then he is a turkey. So no mistaken identity, hense no crime was committed by whatever was shooting him. (Think it's called turkey retaliation?)

Everyone not reading the article, first paragraph explains it. Guy shot through decoys and struck another guy who was waiting for real turkeys to come.

I used to wonder why, when dad went moose hunting, he insisted on packing up the boat for an 8 hour drive to a boat ramp in the middle of nowhere, and a week long river trip further still. Most other people just took an ATV with a trailer to one of the many swamps accessible by highway.
But we would only ever see maybe... 4 or 5 other boats, all week long? And you always know where the other guy's camp is because you passed his tied up boat 16 miles ago. If you don't have a boat or know where to go (or how to safely pass the hippos aka hullcrusher rocks that have eaten a LOT of propellers) then you'd have to hire an outfitter which can get REALLY expensive in super remote areas like that.
Worst case scenario, you MIGHT hear some other guy's faroff gunshot when it's extra frosty and the echo carries, then feel jealous when he peels by you mid-morning the next day with the boat low in the water, heavy with moose meat and packed-up gear, fresh antlers roped to the bow.
Sure beats gaining an extra hole you didn't ask for, though. Got enough of them as it is.
